THESE TERMS

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or require any changes, please contact us to discuss.

ACCEPTANCE OF ORDER

We will provide you with a written Confirmation of Order, at which point a binding contract will come into existence
between you and us. If there is any inconsistency between these terms and our Confirmation of Order, the Confirmation
of Order will prevail.
The Company will only agree to supply and install goods after we receive written confirmation by the customer agreeing
to the position layout and product specification as well as the 50% deposit required. The order will only be put into the
production schedule once these conditions are satisfied.

PAYMENT TERMS

Payment shall be in the following terms:
50% deposit on order (lead time and stock ordered on receipt of deposit payment)
45% no later than 7 working days prior to scheduled installation date
5 % immediately upon practical completion

UPSTANDS

Precision in Upstand Construction:
The upstand must be constructed with a tolerance of ±1mm. This level of precision is crucial to
ensure a perfect fit for the doors and to maintain the integrity of their operation.
Drainage Requirements:
It is essential that the upstand allows for sufficient drainage on its external face. This should be in
line with our approved detailing and not cover any external drainage slots, which is designed to
prevent water accumulation and to direct runoff away effectively from the door area.
Marking of Finished Floor Level:
During the surveying and installation phases, we require that the finished floor level be clearly
marked within the door installation area. This marking is vital for the accurate alignment and smooth
operation of the doors.

Please ensure these criteria are met thoroughly. The correct construction of the concrete upstand is essential not only for
the aesthetic alignment of the doors but also for their functional longevity and the overall waterproofing and drainage
efficacy of the installation area. It is the client’s/contractor’s responsibility to ensure that upstands are built within a
tolerance of (+-)1.0mm. Failure to comply to these specifications will result in additional costs.

MANUFACTURE

All glass used is the best obtainable, but we will not guarantee against minor imperfections which cannot be guaranteed
against. Glazing will be constructed in accordance with BS 5713 and all U – values stated are Argon gas filled. Glass will
be supplied and installed in accordance with the manufacturer’s quality standards allowing for imperfections resulting
from limitations within the manufacturing process and as defined in accordance with GGF guidelines Section 4.10 or the
Hadamar “Guideline to access the visible quality of glass in buildings” June 2009.

As part of the normal float glass process, tempered glass may contain nickel sulphide inclusions which might lead to, in
very rare circumstances, spontaneous breakages, even after heat soak testing. The glass manufacturers cannot guarantee
the exclusion of all nickel sulphide inclusions, nor can they (or the Company), take any responsibility for the costs
incurred for replacement units or associated costs.
Sample units are intended to demonstrate the construction of a typical window, door etc., and the materials used. The
units to fulfil this order will be manufactured by the Company and will be of whatever construction and material the
Company considers most suitable, following inspection and measuring by its company or representatives. The Company

Will adhere to the Glass and Glazing Federation guidelines regarding quality of product.
This does not affect your statutory entitlements.

The company guarantees glass units for a period of ten years from date of installation. Should any defect arise due to
faulty materials or workmanship during that period a replacement unit will be provided by the company. The warranty
specifically covers broken down units i.e. where condensation is visible in between the panes of glass. There will be no
call-out charge during the first year. Thereafter, the following call-out fees will apply, €85 call-out/first hour and €70 per
additional operative for all subsequent hours, not including any mechanical access equipment that may be required.
Costs are subject to VAT

INSTALLATION AND REPLACEMENT

Unless expressly mentioned, the Company issues estimates for installation into new and prepared openings only, and no
“making good” of window and door openings or other building works are included. The Company is not contracted to
remove windows and/or doors whole and cannot be held responsible for any damage to panes/doors/frames removed to
make way for the new installation.
The Company cannot under any circumstances be held responsible for any damage internally or externally, directly or
indirectly caused as a result of any structural defect in the building.
For Supply only sales, the price does not include on-site assistance. There will be a call-out charge for any site assistance
requested.
Whereas the Company will make every endeavour to avoid damage to the customer’s property, reasonable precautions
to protect furniture, furnishings, carpets, and effects in the immediate working areas must be taken by the customer.
The customer shall permit the Company, its servants and agents to have access to the installation address at reasonable
times in connection with the installation.

PROTECTION, CLEANING AND HANDOVER

Aluminium surfaces are supplied with a factory applied low-tak PVC tape which will protect them from most scratching,
weld splatter or disc cutting. It is the responsibility of the main contractor or client to provide glass protection such as
applying ‘Peelguard’ film to vulnerable areas of glass such as the external ground floor and internal from each floor up to
1.5m high. Protection should be left in place until the end of the construction works when it can be easily removed by
the Contract cleaners being employed by the Main Contractor or Client. We confirm that once each screen is installed,
handed over and incorporated into the works, the responsibility for damage, further protection and any subsequent
clean downs transfers to the main contractor. The Company carry out a handover procedure whereby completed
sections are inspected and signed off once installed to a nominated representative of the main contractor or client.

We have not included for a complete “builders clean” prior to Practical Completion.

GLAZED ROOFLIGHTS

The Company will not accept any responsibility for the ponding of rainwater on glazed rooflights regardless of pitch. It is
the customer’s responsibility to ensure an adequate pitch is prepared on the upstand. We recommend a minimum pitch
of 5 or more degrees to avoid ponding of rainwater on rooflights.
Plastering should not be carried out prior to installation of rooflight. Please note that the black fritted edge on the

rooflight system is optional and designed only as an aid to conceal the build-up of the builder’s upstand. Further work
may be required by the builder to conceal the upstand. All upstand should be constructed using and internal insulated
plasterboard to reduce the chances of internal condensation.

DESIGN CRITERIA (ASSUMED unless stated otherwise)

Whilst preparing our tender we have had to consider a number of design factors which influence the selection of both the
aluminium glazing system and glass required for this project. These factors are listed below and in instances where design
information has not been included in your original enquiry, we have had to make certain assumptions. It is the client’s
responsibility to ensure that we are in possession of all necessary design information prior to commencing construction
drawings and we would advise you that any betterment to the figures stated below will incur additional costs.

  • Wind Load – 1200 Pa (1.2 kN/m²)
  • Barrier loading to BS 6180
  • Deflection Criteria – In line with CWCT recommendations
  • Building Movement – The systems we offer have limited building movement. Any excessive building movement
    or deflection must be highlighted at the design stage (+-2mm)
  • U-Values – Generally in compliance with the performance specification.

SECONDARY STEEL

We have not allowed for any secondary steel structure behind the screens or above or below the door systems. All
secondary supporting structures will be to be design and constructed by others.

PRESSED METAL FLASHINGS

All pressing services are considered additional services unless explicitly included in our initial tender letter. Such services
must be clearly identified and agreed upon during the tender phase prior to finalising the contract price.

Charges for Additional Pressing Services
Any pressing services requested beyond those agreed upon in the tender letter will incur additional charges. These charges
will be calculated based on administrative and labour costs plus the cost of materials. Agreement and payment for any
additional pressing services must be finalised before the commencement of installation.

Specifications for Pressed Metal Flashing
Unless otherwise specified, pressed metal flashing will be produced using 2mm thick aluminium, powder-coated according
to client specifications. The type of insulation material must be approved by the client or their architect and installed by
the main contractor. It is the responsibility of the main contractor to ensure that all necessary details are finalised before
measurement and production can proceed.

Lead Time and Scheduling
The estimated lead time for pressed flashing is 3-4 weeks, commencing from the date of measurement and confirmation
of project details. Given the unique nature of each project, including site conditions and complexity, the scheduling of these
works will be determined on a case-by-case basis. It is possible that work may be scheduled only on specific days of the
week or times of the month to accommodate project requirements. Some projects may require additional flashings to
obtain attractive finishes around the buildings structural work and surrounding areas. It is the client’s responsibility to
ensure this is discussed and agreed at the time of initial order of the product, as in later stages it will incur delays and
additional charges. If not agreed otherwise, this will be treated as a separate contract and not effecting the final payment
on the original contract.

SILCONE & SEALING APPLICATIONS

General Provision
External silicone application is not included unless specifically required for structural silicone applications. If silicone sealing
works have being allowed for it is based on a standard gap width of 5mm. Any requirements for silicone application with
gap widths exceeding 5mm will incur additional charges, calculated on a per linear meter basis.

Expanding Foam Sealing
Standard practice includes the use of expanding foam for sealing gaps between apertures and the surrounding structure,
up to a maximum depth of 10mm. Requests for expanding foam application beyond this depth will be subject to additional
charges, also on a per linear meter rate.

Sealing to Brickwork
Please note that sealing to brick details is not included within our standard services. Such work requires the expertise of
specialist subcontractors and will be charged based on the specific requirements of each project, upon the request of a
quotation.

MAINTENANCE & REPAIRS

Warranty and Repair Coverage
Our products come with a warranty coverage of 20 Years for powder coated profiles (excluding supplementary items such
as pressed metal flashing) 10 years for double & triple glazed units, and 12 Months ironmongery & moving parts. Any
repairs required within the first 12 months have no additional charges associated with the works. Repairs required after
this period will be charged on a basis that includes labour, travel, and administrative expenses for the duration of the
warranty period.

Repair Request Process
All repair requests must be formally submitted and prices agreed upon in advance. A deposit is required before the
commencement of repair works. It is acknowledged that not all issues can be fully assessed through discussions and
photographs alone. Therefore, additional work and associated charges may be identified following an on-site inspection,
which takes into account the complexity of the site and required repairs. Additionally, repair works may be scheduled for
specific days of the week or months, depending on various factors.

LIFTING AND HANDLING EQUIPMENT

Horizontal distribution will be by hand or trolly weight dependent and limited to 200kg manually. A clear, safe access way
must be provided by the main contractor with a minimum height of the tallest panel of glass plus 250mm x 750mm wide.
Where horizontal distribution is required by a trolly (Glass above 200kg no further than 20m from the A frame location)
ply sheeting must be provided for any surface other than a solid smooth surface that does not require protection. The ply
sheeting most be overlapped with the high side in the direction the trolly will be traveling from the A frame location to
the installation area. Please inform us during the ordering process if you anticipate the need for a crane or any lifting
equipment to install our product at your location. Our initial quote does not cover the expenses for handling or lifting
equipment unless this need is explicitly communicated to us and included in our proposal. A site inspection will allow us
to determine if such equipment is required. The costs for any necessary equipment cannot be estimated prior to this
survey. Should the installation require specialized equipment, we will discuss and finalise the costs with you following the
survey and prior to issuing the Order Confirmation. We do not assume liability for any lifting or handling equipment
utilized in moving or installing our products, except when the equipment is owned or rented by us.

SUPPLY ONLY CONTRACTS

If we are making the product to provided measurements, you are responsible for ensuring that these measurements are
correct. We do not accept liability for any fault caused by any error or omission by you having undertaken any installation
yourself or through a third party, and you will be liable for any costs arising from you having provided us with incorrect
measurements or specifications.

DAMAGE AND REPAIR

Scratches to glass or frame must be reported within 24 hours of installation. The Company cannot be held responsible for
normal wear and tear or damages resulting from abuse or misuse of the products.
It is impossible to ascertain from a survey whether the brick work or any area of tiles, plaster or rendering is likely to
collapse during the course of installation or replacement. While the Company will use the utmost care to prevent the
collapse of any structural works, any repair work found to be necessary will not be the responsibility of the Company.

BI-METAL EFFECT

The bi-metal effect will occur on ventilation vents when there is a temperature difference between the
inner and outer half scale of a thermally broken profile. This is the case for warm exterior environments
and extreme cold exterior environments.
Direct solar radiation
The ventilation vent profile will temporarily bend when heated up by solar radiation. The colour of the
profile, the location and orientation of the element have a significant influence. The solar radiation is
more direct on the East and West oriented facades, due to the profiles being vertical and the low
position of the sun at these orientations.

The actual radiation on the profiles will be influenced by the real situation (e.g. surrounding buildings,
solar shading, trees, cloud coverage, atmospheric conditions etc.) which might cause additional
shading and should be evaluated in function of the project.

QUALITY OF OUR PRODUCTS

We give the following guarantees on our products:

  • Aluminium Products – Aluminium frames are guaranteed against distortion and joint failure for 10 years from the date of delivery or installation.
  • Glass – Glass sealed units are guaranteed against failure of hermetical seals (i.e. misting between panes) for 10 years from the date of delivery. This guarantee does not cover glass breakage after installation, which is at your risk.
  • Glass sealed units are not covered by nickel sulphide inclusions and damages as a result.
  • We follow guidelines set out by the Glass and Glazing Federation (GGF) for quality and clarity of glass and these guidelines are deemed to be included in our agreement.
  • Stainless steel products are guaranteed for 10 years provided you clean and maintain them in accordance with our recommendations.
  • When replacing glass units under guarantee we will do so on a like for like basis. If an exact replacement is no longer available, we will supply the nearest equivalent available.
  • Our guarantee does not cover the cost of specialist handling or lifting equipment needed to replace products under guarantee in cases where the need arises because access to the site has become more difficult since installation, or if specialist handling or lifting equipment was used during the original installation.
  • Powder Coating – Our powder coated products (excluding pressings), are guaranteed for a period of 20 years period for paintwork, against fading or corrosion. We follow the guidelines set out by Qualicoat (14th edition for the quality of our powder coating.
  • We guarantee powder coated products for 5 years against fading and or corrosion where they are installed within 0.5 miles of the sea.
  • When we are installing powder coated products within 0.5 miles of the sea, we may reduce the guarantee period because the sea air is more corrosive. We will provide details of the guarantee period when we have carried out our survey if applicable.

Ironmongery – Warranties & Liability
1. Subject to the conditions set out below the Seller warrants that the Goods will correspond with their specification at
the time of delivery and will be free from defects in material and workmanship for a period of 12 months from the date
of their initial use or 12 months from delivery, whichever is the first to expire.
2.The above warranty is given by the Seller subject to the following conditions:

  • a. NRGI shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage,
    negligence, abnormal working conditions, failure to follow the Seller’s instructions (whether oral or in writing),
    misuse or alteration or repair of the Goods without NRGI approval;
  • b. The Seller shall be under no liability under the above warranty (or any other warranty, condition or guarantee)
    if the total price for the Goods has not been paid by the due date for payment;
  • c. The above warranty does not extend to parts, materials or equipment not manufactured by NRGI.

Any claim by the Buyer which is based on any defect in the quality or condition of the Goods or their failure to
correspond with specification shall (whether or not delivery is refused by the Buyer) be notified to the Seller within 7
days from the date of delivery or (where the defect or failure was not apparent on reasonable inspection) within a
reasonable time after discovery of the defect or failure. If delivery is not refused, and the Buyer does not notify the Seller
accordingly, the Buyer shall not be entitled to reject the Goods and the Seller shall have no liability for such defect or
failure, and the Buyer shall be bound to pay the price as if the Goods had been delivered in accordance with the Contract.
4. Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the
Goods or their failure to meet specification is notified to the Seller in accordance with these Conditions, the Seller shall
be entitled to replace the Goods (or a proportionate part of the price), but the Seller shall have no further liability to the
Buyer.
5. Except in respect of death or personal injury caused by the Seller’s negligence, the Seller shall not be liable to the
Buyer by reason of an representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at
common law or under the express terms of the Contract, for any indirect, special or consequential loss or damage

(whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused
by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply
of the Goods or their use or resale by the Buyer, and the entire liability of the Seller under or in connection with the
Contract shell not exceed the price of the Goods, except as expressly provided in these Conditions.
6. The Seller shall not be liable to the Buyer or be deemed to be in breach of the Contract by reason of any delay in
performing, or any failure to perform, any of the Seller’s obligations in relation to the Goods, if the delay or failure was
due to any cause beyond the Seller’s reasonable control. Without prejudice to the generality of the foregoing, the
following shall be regarded as causes beyond the Seller’s reasonable control.

  • a. Act of God, explosion, flood, tempest, fire or accident;
  • b. War or threat of war, sabotage, insurrection, civil disturbance or requisition;
  • c. Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any
    governmental, parliamentary or local authority;
  • d. Import or export regulations or embargoes;
  • e. Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of the
    Seller or of a third party);
  • f. Difficulties in obtaining raw materials, labour, fuel, parts or machinery;
  • g. Power failure or breakdown in machinery;

Powder Coating – Warranties & Liability
1. The warranty does not cover wilful, intentional or accidental damage.
2. Damage caused by changes made to the profiles or materials afterwards.
3. All damaging on the coating due to unusual use and normal ageing caused by mechanical contact large changes and
thermal shocks rubbing of items or objects damaging not affecting the aesthetic appearance of the work poor water
drainage of the concept aggressive and polluted environment.
4. Damage due to cleaning of corrosion of the materials caused by non-neutral chemicals.
5. Damage due to the use of product installed where it was not designed or intended to be used.
6. The material coated is sited within direct influence of zones of salt water (within 500 metres of high tide line) acid or
industrial or other aggressive emission sources which are known or believed to be damaging or corrosive to thermosetting
powder coating.
7. The whole or partial replacement of the profiles or parts of it.
8. Direct or indirect damage due to deformation of the materials after the installation.
9. Damage due to one or more electric current due to the use of alloys or materials, which are not compatible with
aluminium, copper, lead, zinc stc.
10. Less than 5% of the exposed external surface is affected.
11. Failure to follow cleaning and maintenance guidelines.

Cleaning & Maintenance
1. Cleaning & Maintenance

  • a. In areas within the direct influence zones of salt water, industrial chemical plants, blast furnaces or other
    aggressive emission sources, the window should be cleaned at least every three months. In relatively cleaner
    environments, every six months should be sufficient.
  • b. Procedure
    • i. Wash down with clean warm water containing non-alkaline liquid detergent (in concentration that can
      be handled safely with bare hands) using non-abrasive cloth, sponge or soft bristle brush. This will
      remove grime, grease, and any excess chalking. All ridges, grooves, joints and drainage channels where
      salt or other deposits can collect should be well washed out, thus preventing corrosion sites from
      occurring.
    • ii. Rinse thoroughly with clean water.
    • iii. Dry using a soft cloth or leather.
  • c. Where a reduction in glass is observed, chalking is evident or excessive staining has occurred, an approved
    renovating cream may be carefully applied with a non-abrasive cloth.
    Note: T-Cut or similar automotive paint restorer may be used provided it is not too abrasive.

Care must be taken not to abrade sharp corners of sections or beads too heavily where the paint film is normally thinner.
It should be noted that this operation should not be carried out too frequently.
Polish with a soft cloth to restore gloss and maintain colour uniformity.
d. For extra protection a wash polish can be applied once or twice a year again polishing with a soft cloth to restore
glass.

2. Repair

  • a. Blisters and corrosion sites may originate from areas where mechanical damage or scratches have penetrated
    the paint coating through to the aluminium, or from cut bar of butt ends, mitres, drill holes or drainage slots,
    where the aluminium is unprotected.
  • b. Procedure:
    • i. Use fine grade 120-360 grit abrasive paper to remove corrosion products and any non-adherent paint.
    • ii. Wipe with white spirit or approved cleaning solvent.
    • iii. Ensure surface is absolutely dry before applying a thin priming coat. Allow 20-30 minutes to “Flash
      Off” using a fine brush.
    • iv. With a fine brush, touch in the damaged and primed area with an air drying paint. It should be
      recognised that the air drying paint will not possess the same weathering properties as the powder
      coating, but nevertheless will give a reasonable amount of protection. Their use should of course be
      confined only to small areas of damage.

3. Window Hardware and Maintenance

The Friction stays and locking mechanisms should be lubricated periodically to minimise wear and to ensure smooth
operation. Care should be taken to avoid applying lubricant to the friction pads, as this will impair their braking action.
The resistance of the pads can be adjusted, if necessary with the brass screws provided in each pad.

4. Doors Hardware and Maintenance
Hinges and locking mechanisms should be lubricated periodically to minimise wear and tear to ensure smooth operations.

GUARANTY CLAIMS

All guaranteed claims should be notified to us in writing at info@nrgi.ie
You should do so promptly and in any event within 7 days of noticing the problem.

CHANGES TO YOUR SITE OR BUILDING AFTER SURVEY OR SPECIFYING THE SIZES OF THE PRODUCTS

When we carry out our survey, we measure the size of the openings into which our products are to be installed, so that we
can make our products to fit, clients / builders must ensure that the sills are in place and that all openings are prepared
properly.
Where you are carrying out building work that affects the installation it is your responsibility to ensure that you construct
the openings to suit the products you order with us, as advised in the survey information provided to you, including the
upstand criteria etc.

CANCELLATION AND RESCISSION

All units are specially made to order, and consequently the contract is not subject to cancellation. If any customer does
so cancel, then the Company shall have the right to retain the deposit being 50% of the total price and in addition, to
claim against the Customer for any costs incurred and for any loss of profit which accrues.
The Company reserve the right to cancel this contract should our surveyors report prove unsatisfactory, whereupon any
deposit paid will be repaid in full and this agreement shall be at an end.
